THE DETAILS

Terms & Conditions

Please review the following terms before using our website or engaging our digital marketing services.

These terms apply to your use of the Advertisingwala website and our services, subject to any separate written proposal or agreement that applies to your project.
01

Introduction and Acceptance

Welcome to Advertisingwala. These Terms & Conditions govern your access to our website and digital marketing services, including Performance Marketing, SEO, Social Media Marketing and Graphic Designing.

By using our website or engaging our services, you agree to the terms applicable to your interaction with us. If you do not agree, please do not use the relevant website features or services.

A separate proposal, quotation or signed service agreement may include additional terms for a specific project. Where applicable, those project-specific terms will govern the services they expressly cover.

02

Our Services

Advertisingwala provides digital marketing and creative services to businesses. Depending on your agreed scope, these may include:

  • Performance Marketing: paid campaign planning, advertising management, lead generation and optimisation.
  • SEO: keyword research, on-page optimisation, technical recommendations and content support.
  • Social Media Marketing: content planning, social media creatives and campaign management.
  • Graphic Designing: promotional designs, ad creatives and brand visuals.

The exact deliverables, platforms, timelines and reporting frequency will be set out in the relevant proposal or written agreement. Services not expressly included are excluded unless agreed separately.

03

Eligibility and Website Use

You agree to use our website lawfully and provide accurate information when contacting us or requesting services. If you act for a business, you confirm that you are authorised to make the relevant enquiry or arrangement.

  • Do not use our website for unlawful, fraudulent or misleading activities.
  • Do not attempt to gain unauthorised access to our website or systems.
  • Do not submit malicious code, spam or materials that infringe another person's rights.
  • Do not misrepresent your identity, business or authority.
04

Client Responsibilities

Clients agree to provide accurate business information, timely approvals and the access or materials reasonably required to deliver agreed services.

  • Provide accurate information about your business, products, prices and offers.
  • Ensure you have permission to use the logos, images, videos, text and other materials you provide.
  • Review and approve designs, advertisements and campaign details within agreed timelines.
  • Maintain appropriate ownership or authorised access to your website and marketing accounts.
  • Notify us of changes that may affect project delivery.

Delays in approvals, access, payments or materials may affect timelines and campaign performance.

05

Proposals, Scope and Changes

Proposals may specify deliverables, fees, timelines, payment milestones and project requirements. Work may begin after required approvals, onboarding, payment and access have been completed.

Requests outside the agreed scope may require additional fees or an adjusted timeline. Material changes should be agreed upon before additional work proceeds.

06

Fees, Payments and Taxes

Service fees, billing frequency and due dates will be stated in the applicable proposal or invoice.

  • Payments must follow the agreed invoice or payment schedule.
  • Applicable taxes will be charged as required by law.
  • Advertising spend, premium tools, hosting, stock assets and third-party charges are additional unless expressly included.
  • Additional work or expenses should be approved under the agreed project arrangements.

Where permitted by the agreement and applicable law, overdue payments may result in suspension of affected services after reasonable notice. Refunds and cancellations are governed by the applicable agreement and relevant law.

07

Advertising Campaigns and Third-Party Platforms

Paid campaigns may use platforms such as Google Ads, Meta Ads and other advertising networks. Campaign delivery depends on platform rules, account status, budget, approval processes and market conditions.

  • Advertising budgets are separate from our management fees unless agreed otherwise.
  • Platforms may reject ads, restrict accounts or change their policies.
  • We do not control platform outages, account reviews, auction prices or changes to third-party services.
  • Clients remain responsible for the accuracy and legality of their business claims and offers.

We use reasonable professional efforts to manage agreed campaigns but do not guarantee a particular number of leads, clicks, sales or return on advertising spend.

08

SEO and Marketing Results

SEO and marketing results depend on competition, website condition, content, demand, advertising budget, algorithms and other factors beyond our control.

We do not guarantee specific search rankings, traffic, enquiries, sales, revenue or growth percentages unless expressly stated in a separate written agreement. Estimates and historical performance do not guarantee future results.

09

Intellectual Property

Each party retains ownership of intellectual property it owned before the project. Clients confirm that they have the necessary rights to materials supplied to Advertisingwala.

Ownership and permitted use of final deliverables created for a client will be governed by the applicable written agreement, including any payment requirements and third-party licence conditions.

Fonts, stock images, templates, software and other third-party assets may remain subject to separate licence terms. Source files are not included unless expressly agreed.

10

Confidentiality and Privacy

Both parties should take reasonable care to protect non-public business and project information received from the other party and use it only for legitimate project or business purposes.

Personal information collected through our website is handled according to our Privacy Policy and applicable data protection requirements. Please do not send passwords or sensitive personal information through ordinary enquiry forms.

11

Cancellation, Suspension and Termination

Cancellation notice periods and termination procedures will be governed by the applicable proposal or service agreement. If no procedure has been agreed, please contact us in writing to discuss cancellation.

Fees for work performed, approved expenses and other amounts payable under the agreement remain subject to the applicable cancellation terms and law.

Where reasonably necessary, services may be suspended or terminated for serious non-payment, unlawful instructions, security risks or a material breach, subject to the agreement and applicable law.

12

Disclaimers and Limitation of Liability

We aim to deliver our services with reasonable care and professionalism. However, website availability, advertising platforms, search algorithms and third-party services may change or experience interruptions outside our reasonable control.

To the extent permitted by law, Advertisingwala is not responsible for indirect or consequential losses arising from matters outside our reasonable control. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, or rights protected by mandatory applicable law.

13

Updates and Contact Information

We may update these terms to reflect changes to our services, website, business practices or legal requirements. Updated terms will be published on this page. Material changes to an existing service agreement will be handled according to that agreement and applicable law.
